Terms and Conditions
Joel Overstreet Media LLC
Effective date: October 20, 2026
These Terms and Conditions describe the terms for booking photography, video, and related media services with Joel Overstreet Media LLC (“we,” “us,” or “our”), based in Roswell, Georgia.
Our website is joeloverstreet.com.
1. Project Agreements and Acceptance
These Terms apply to bookings and project agreements that reference them and are presented for your acceptance.
Your accepted quote, booking confirmation, or written project agreement identifies the services, deliverables, pricing, scheduling, and any project-specific conditions.
If a project-specific written agreement conflicts with these general Terms, the project-specific agreement controls.
You must have the legal capacity and authority to enter into the agreement. If booking on behalf of a business, property owner, or other client, you must be authorized to arrange the services.
2. Services and Project Scope
We provide photography, video, real estate media, branding content, portraits, and related services as described in the applicable booking or project agreement.
Only the services and deliverables included in the agreed scope are included in the project price.
Additional locations, deliverables, filming time, editing, or other services may require an updated quote. Additional charges and changes to the project schedule must be agreed upon before the additional work proceeds.
Appointment availability is subject to confirmation.
3. Deposits and Payment
For individual projects, a 50% deposit of the quoted project fee is required to reserve the booking. The deposit is applied toward the total project fee.
The remaining balance is due the day before the scheduled project date.
Any separately approved location, studio, equipment rental, permit, or other third-party expenses will be identified in the quote or project agreement, including any advance payment requirements.
Payments are processed through checkout using Stripe.
The deposit is nonrefundable when the client cancels, subject to the exceptions and applicable rights described in these Terms. One permitted deposit transfer is available under Section 5.
Monthly content programs follow the billing terms in Section 9 rather than automatically requiring an additional individual-project deposit.
Media usage rights begin after the applicable invoice has been paid in full and the finished media has been delivered, unless a written agreement expressly provides otherwise.
4. Client Responsibilities
You are responsible for:
Providing accurate contact, booking, property, and project information.
Arranging authorized access to the location.
Communicating access restrictions, special requirements, and required shots before the appointment.
Preparing the location and coordinating people needed for the project.
Helping secure permissions necessary for the agreed photography, filming, and intended use.
Reviewing factual information supplied for inclusion in the deliverables.
Discuss privacy requirements, sensitive content, and restrictions on photographing particular areas or people before booking.
If missing access, incomplete preparation, or changes to the agreed brief affect the project, we will discuss any necessary changes to the scope, schedule, or price.
Property access information is handled as described in our Privacy Policy.
5. Cancellations, Rescheduling, and Missed Appointments
Send cancellation or rescheduling requests to contact@joeloverstreet.com.
The standard deadline is at least 24 hours before the scheduled project start time.
Rescheduling with at least 24 hours’ notice
Your existing deposit may be transferred to one rescheduled appointment, subject to availability.
The deposit remains nonrefundable and is credited toward the rescheduled project. Any changes to the project scope or approved expenses will be addressed separately.
Only one deposit transfer is included. Further rescheduling requires a new booking and deposit unless otherwise agreed in writing.
Client cancellations
If you cancel, we retain the 50% deposit, subject to applicable law.
You may also be responsible for eligible third-party expenses already incurred specifically for your project, as described below.
Any remaining prepaid balance will be returned after the retained deposit and eligible expenses have been accounted for.
Changes within 24 hours and missed appointments
A cancellation, rescheduling request made less than 24 hours before the appointment, or missed appointment does not qualify for the standard deposit transfer.
We retain the deposit and any eligible third-party expenses. A replacement appointment requires a new booking and deposit unless we agree otherwise in writing.
We do not automatically charge the full remaining project fee solely because of a late cancellation or missed appointment.
Third-party expenses
Additional cancellation costs are limited to expenses that:
Were disclosed and approved before being committed.
Were actually incurred for your project.
Cannot reasonably be refunded, canceled, or recovered.
Are not already covered by the deposit or other amounts retained for that same expense.
Examples include approved location fees, studio bookings, equipment rentals, and permit costs.
We will provide an itemized explanation of retained or additional expenses and account for applicable supplier refunds or credits. The same expense will not be charged twice.
Changes initiated by us
Rescheduling initiated by us does not use your one permitted client-requested deposit transfer.
If we cancel and cannot agree on an acceptable replacement arrangement, we will refund the deposit and amounts paid for services we will not provide. Any separately approved third-party expenses will be addressed under the applicable agreement, supplier terms, and law.
Nothing in this section removes a cancellation or refund right that cannot lawfully be waived.
6. Weather, Access, and Operating Conditions
Weather, unsafe conditions, restricted access, airspace limitations, and other circumstances may affect outdoor photography, filming, or aerial services.
Aerial and drone services can be performed only when conditions and applicable authorizations permit.
We may pause or reschedule work where necessary to address safety, access, or legal requirements. We will communicate any resulting changes and discuss an appropriate alternative.
These circumstances do not automatically override a delivery guarantee. Any adjustment to an agreed delivery commitment must be addressed through the applicable offer, project agreement, subsequent mutual agreement, or applicable law.
7. Delivery Timing and the 72-Hour Guarantee
Real estate listing media
Our 72-hour delivery guarantee applies exclusively to real estate agents booking listing media.
The complete agreed listing-media package, including any included video, will be delivered within 72 consecutive calendar hours after the shoot finishes. Weekends are included.
Delivery means making the finished deliverables or their access links available to the client. It does not guarantee when an independent listing platform will publish them.
Photos, 3D tours, and 2D floor plans are often delivered within approximately 24 hours. That is typical turnaround; the guaranteed deadline for the complete listing-media package is 72 hours.
If we miss the applicable 72-hour deadline, we will provide a 5% discount on the service fee for your next project.
This benefit does not remove other rights or remedies that cannot lawfully be excluded.
Other projects
Projects outside qualifying real estate listing media generally take 7–14 days. The expected delivery schedule will be confirmed for the specific project.
Additional work, revisions, or agreed changes may have a separate delivery schedule.
Existing bookings
Bookings made under an earlier delivery commitment remain subject to the commitment applicable when they were accepted. Publishing these Terms does not retroactively replace an existing 48-hour guarantee.
8. Creative Direction, Corrections, and Revisions
Our portfolio provides examples of our photographic and editing style. Specific requirements should be communicated before booking and included in the project scope.
Unless a project-specific agreement states otherwise:
Each project includes one complimentary revision round.
A revision round means one consolidated list of requested changes.
Revision requests must be submitted within seven calendar days after delivery of the completed project deliverables.
Additional revision rounds cost $50 per round, with the charge confirmed before the additional work proceeds.
New concepts, substantial changes to the original brief, additional deliverables, or reshoots may require a separate quote rather than qualifying as an ordinary editing revision.
Corrections needed because of an error on our side are handled separately from chargeable client-requested revisions.
The revision-request window does not remove applicable rights concerning services that were not provided as agreed.
9. Monthly Content and Ongoing Programs
Initial commitment
Monthly content programs have an initial commitment of three months, unless a separate written agreement expressly provides otherwise.
The program agreement identifies the monthly deliverables, sessions, scheduling arrangements, and fees.
Monthly payment
Each monthly service period is paid in advance, before that period begins.
Monthly billing does not shorten the agreed initial commitment. Any agreed early termination and treatment of remaining work or payments must be documented in writing, subject to applicable law.
These general Terms do not impose a separate early-termination penalty or automatically accelerate all remaining installments into an immediate lump-sum payment.
Continuation and cancellation
After the initial three months, continued service requires an agreement to proceed month to month. Completion of the initial term does not, by itself, authorize further recurring charges.
An ongoing month-to-month arrangement may be canceled with 30 days’ written notice to contact@joeloverstreet.com.
Notice may be provided during the initial term to request that service end when the initial commitment is completed. Notice does not automatically shorten that commitment.
We will confirm the applicable service end date and any remaining scheduled obligations.
Any automatic monthly renewal or recurring payment must be expressly authorized under the program agreement.
Unused deliverables and scheduling
Unused included deliverables may roll forward for one billing cycle, subject to scheduling availability. They do not accumulate indefinitely.
Where a delay is caused by us, we will arrange replacement scheduling or an appropriate credit or adjustment. Our own delay will not be used to eliminate paid-for work without an appropriate resolution.
Program-specific session rescheduling arrangements will be identified in the program agreement.
Media rights
The applicable month’s invoice must be fully paid before usage rights begin for that month’s delivered media.
Licenses already granted for fully paid service periods continue under the Media Licensing terms. A later unpaid period does not automatically revoke an earlier, fully paid license.
10. Media Licensing and Copyright
Our Media Licensing page explains the permissions included with delivered media and forms part of a project agreement when incorporated into that agreement.
In particular:
Copyright and other rights remain with us or the applicable rights holders unless separately transferred in writing.
The standard client license is nonexclusive and specific to the agreed project.
Usage rights begin after full payment and delivery.
Paid advertising is included within the authorized project scope, subject to third-party asset restrictions.
Routine cropping, resizing, captions, and client branding are permitted.
Substantial alterations require permission unless included in the project agreement.
The original real estate client retains authorized portfolio and “just sold” usage.
A new agent or another independent business must obtain authorization before reusing media outside the original license.
Raw footage, raw photographs, and editable project files are excluded unless separately agreed upon in writing.
Having access to a file or gallery does not grant unrestricted ownership or usage rights.
11. Portfolio Use, Private Projects, and Children’s Images
Our booking agreement includes permission for our use of project media on our website, in our portfolio, on social media, and for other promotional purposes.
Requests to exclude media from these uses should be discussed before booking. Project-specific restrictions we agree to will be honored.
Private or password-protected delivery may be arranged. Gallery access restrictions and restrictions on our promotional use are separate matters and should both be addressed where needed.
Public promotional use of media showing identifiable children requires permission from a parent or legal guardian, as addressed in the project agreement.
12. Editing Contractors, AI Processing, and Other Providers
We use independent editing contractors in the United States and abroad. Contractors receive access to the files needed for their assignments.
We also use AutoHDR for real estate and property photographs, rather than portrait editing.
AutoHDR’s published terms permit certain uses beyond completing an individual edit, including AI training, development, marketing, and retention of certain copies. These practices are described in AutoHDR’s Privacy Policy and our Privacy Policy.
Private projects may still be processed by our editors and AutoHDR. Restrictions agreed between you and us do not automatically change a provider’s separate rights under its terms.
Booking, payment, storage, and publication platforms also have their own terms and practices. Their involvement does not remove our own obligations under your project agreement or applicable law.
13. File Retention and Client Backups
Our own raw photo and video working files are deleted 90 days after delivery.
This schedule does not establish a deletion deadline for backups or copies retained independently by editing contractors or service providers.
We currently retain delivered media without a fixed automatic deletion period, but we do not guarantee permanent storage, replacement, or continuing gallery access.
You are responsible for promptly downloading your delivered photographs and videos and maintaining your own backup copies.
Files and gallery links may become unavailable. A continuing media license permits authorized use of the copies you retain; it does not create a permanent hosting or archiving obligation.
14. Website Use
You may use our website for lawful purposes, including learning about our services, contacting us, and arranging projects.
You may not use the website to:
Submit fraudulent bookings or knowingly false information.
Attempt unauthorized access to accounts, files, or systems.
Disrupt website operations or introduce malicious software.
Misuse another person’s personal information.
Copy or exploit website content beyond the permissions granted or uses independently permitted by law.
These restrictions do not prevent you from sharing honest reviews or exercising applicable legal rights.
15. Privacy and Cookies
Our Privacy Policy explains how we collect, use, retain, and disclose personal information.
Our Cookie Policy explains website cookies, related technologies, and available preference controls.
Newsletter preferences and website cookie choices are managed separately from the services and licensing terms applicable to a project.
16. Results, Service Concerns, and Resolution
Marketing results depend on factors beyond the media itself. Unless expressly included in an applicable offer or written agreement, we do not guarantee a property sale, sale price, advertising performance, audience reach, or a particular business outcome.
This does not reduce our obligation to provide the agreed services or honor applicable delivery commitments.
If a problem arises, contact contact@joeloverstreet.com with your booking details and a description of the concern. We will review the matter and discuss an appropriate resolution under the project agreement and applicable law.
Nothing in these Terms excludes or limits liability or remedies that cannot lawfully be excluded or limited.
17. Applicable Law and Changes to These Terms
To the extent permitted by law, these Terms are governed by Georgia law and applicable federal law. This does not remove nonwaivable protections available under other applicable laws.
We may update these Terms for future bookings. Changes posted on the website do not automatically rewrite an existing project agreement or retroactively change permissions already granted.
Changes to an existing project must be agreed upon or otherwise permitted by the applicable agreement and law.
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
