Media Licensing

Joel Overstreet Media LLC

Effective date: October 20, 2026

This page explains how clients may use photographs, videos, and other media delivered by Joel Overstreet Media LLC.

A written project agreement may provide different or additional permissions. If that agreement conflicts with this page, the project-specific agreement controls.

1. Copyright and Ownership

Copyright and other rights in the media remain with Joel Overstreet Media LLC or the applicable rights holders.

Purchasing photography, video, or other media services gives you permission to use the finished deliverables within the agreed scope. It does not automatically transfer copyright, ownership of source files, or unrestricted rights to the media.

Any copyright transfer, exclusive license, or broader usage arrangement must be separately agreed upon in writing by the appropriate rights holder.

2. Your License to Use Delivered Media

Unless a written project agreement states otherwise, your license begins after the applicable invoice has been paid in full and the finished media has been delivered.

The standard license is:

  • Nonexclusive: Other parties may also have authorized rights to use the media.

  • Specific to your project: Use must remain within the purpose and scope for which the media was commissioned.

  • Granted to the identified client: Additional businesses, teams, or other users must be covered by the project agreement or separately authorized.

  • Inclusive of paid advertising: Paid promotion is permitted when it supports an authorized use within your project scope.

Unless your project agreement specifies a time limit, the license continues for the authorized uses. Continued usage rights do not guarantee continued gallery access or file storage.

3. Real Estate Listing Media

For real estate projects, the standard license allows the commissioning client and any authorized brokerage or team to use the delivered media to market the photographed property through:

  • MLS listings and related listing distribution.

  • Property websites and real estate listing portals.

  • Websites and social media accounts.

  • Paid digital and social media advertising.

  • Email campaigns, brochures, flyers, and other property marketing materials.

This includes the distribution reasonably necessary for authorized MLS, IDX, syndication, and listing-platform display. Authorized platforms may retain listing content in historical or sold-property records under their applicable terms.

The original client may continue using the media for their portfolio, promotion of completed work, and “just sold” marketing after the listing closes or ends, subject to project-specific restrictions and accurate presentation.

Using the media for a later listing assignment, rental operation, or another materially different purpose requires written permission unless that use was included in the original agreement.

Before submitting media to a platform that requires a copyright transfer or broader rights than your license provides, contact us to confirm compatibility.

4. Branding, Headshots, and Other Business Projects

Branding photographs, professional headshots, social media content, and other business deliverables may be used by the identified client for the business purposes covered by the project agreement.

Authorized uses may include websites, professional profiles, social media, presentations, printed promotional materials, and paid advertising.

Paid advertising is included by default within the agreed project scope. You do not need separate permission from us solely because an otherwise authorized use involves paid placement or a boosted post.

This permission does not expand the license to another business, an unrelated project, resale, or other uses outside the agreed scope. Third-party music, stock assets, and other licensed components remain subject to their own restrictions.

5. Personal and Family Portraits

Unless otherwise agreed in writing, personal and family portrait clients may download their finished photographs, make personal prints, and share the finished media for personal purposes, including on social media.

Commercial use, resale, stock distribution, and licensing to other businesses require separate written permission.

Permission for paid promotion applies only to uses already authorized under the project license. It does not convert a personal portrait license into unrestricted commercial usage rights.

6. Sharing Media with Other People or Businesses

You may provide files to employees, marketing assistants, designers, advertising agencies, or other vendors who need them to carry out your authorized use. Their access does not give them independent rights to use the media for their own promotion or other projects.

Outside authorized listing distribution, you may not sell, transfer, or independently license the media to another agent, brokerage, builder, designer, stager, contractor, publication, or other party without written permission.

For example, a new agent taking over a listing must obtain authorization before reusing media commissioned by the previous agent.

Anyone seeking an additional license should contact contact@joeloverstreet.com.

7. Editing and Alterations

Routine adjustments needed for authorized publication are permitted, including:

  • Resizing and reasonable cropping.

  • Changing file format.

  • Adding captions, contact information, or client branding.

  • Arranging media within a marketing layout.

These adjustments must not materially misrepresent the property, project, people, or original work.

Substantial retouching, generative AI alterations, video re-editing, or other material changes require written permission unless included in the project agreement.

Do not intentionally remove copyright notices, ownership information, or watermarks without authorization. Use supplied unbranded versions where required by a listing platform.

8. Music and Other Third-Party Materials

Deliverables may contain music, stock assets, fonts, platform features, or other materials governed by separate licenses.

Your permission to use a finished deliverable does not give you independent ownership or unrestricted rights to those components. Additional restrictions may apply to advertising, platforms, territories, or other uses.

The inclusion of paid advertising in our standard license does not override restrictions imposed by another rights holder. Advertising must use components cleared for that purpose.

Contact us if you are unsure whether a particular deliverable is suitable for an advertising placement or if you want to extract or reuse a licensed component separately.

9. Our Portfolio and Promotional Use

Our booking agreement includes permission for our use of project media on our website, in our portfolio, on social media, and for other promotional purposes.

Project-specific restrictions agreed upon before booking will be honored. Public use of identifiable children’s images is addressed through permission from a parent or legal guardian.

A private or password-protected gallery does not, by itself, change the agreed media license or portfolio permissions.

Our editing contractors and service providers may still process private projects. Provider practices, including AutoHDR’s handling of property photographs, are described in our Privacy Policy. Restrictions on our own promotional use do not automatically restrict a provider’s separate rights under its terms.

10. Raw Files, Source Files, and Storage

The standard license covers the finished media delivered to you.

Raw photographs, original video footage, editable project files, and other production materials are excluded unless expressly included in a separate written agreement.

Our own raw photo and video working files are deleted 90 days after delivery. That schedule does not establish a deletion schedule for backups or copies held by contractors and providers.

We retain delivered files without guaranteeing permanent storage or continuing access. Files and gallery links may become unavailable.

You are responsible for downloading your finished media and maintaining your own backups. A continuing license permits authorized use of the copies you retain; it does not create a permanent hosting or archiving obligation.

11. Additional Uses and Licensing Requests

If your intended use falls outside the agreed license, contact us before publishing or distributing the media.

Additional permissions may require a separate agreement, additional licensing fees, or clearance from another rights holder. Paid placement alone does not require an additional license from us when the use is already within your project scope.

These terms do not restrict uses independently permitted by applicable law. Updates to this page do not retroactively change permissions already granted under an existing agreement.
